The hearing was called to order at 8:00 p.m.

New Cases

#1496                   Gagnon, Jeffrey                                 96 South Pleasant St.
Seeking two findings and a special permit relative to proposed structure expansion on a non-conforming lot.  Property is situated in the Single Residence B Zone within the Groundwater Protection District.

Notice Read.
Conservation Commission letter dated 4-27-04 read and no objections.
Board of Health letter read and no objections.

Applicant described the project as adding 1400 square feet onto a 1300 square foot house.  The property is currently 3 bedrooms and will remain three bedrooms.  There is an unfinished basement.  The applicant is proposing to enlarge the kitchen, front porch and family room on the first level.  On the second level they propose a den and study lounge addition.  The study lounge will be located at the top of the steps and be wide open.  The den has no door and there will be a 4 foot wide opening and no closet.  They would like to add a larger front porch.

Linda Badoian, 16 Oakland Rd., stated she is delighted to have them in the neighborhood and thinks a porch addition would add to the house.

The Board discussed the case, but decided to vote on May 12, 2004 after they have a chance to look at the property and the surrounding neighborhood.  The Board is concerned about granting such a large increase.

The Board discussed that if the an approval is given, then some conditions will be:  no front porch, and a 5 foot opening on the study.

#1493                   Mathur, Rajendra                                        66 Edgehill Rd.
Seeks variance of approximately 47.5 feet to allow a subdivision of land.  Property is situated in the Rural 1 Zoning District.

Board of Health letter read and no objections.
Conservation Commission did not submit a letter, but spoke regarding subdivision of property and how it would create two non-conforming lots and feels it would be setting a bad precedence.

Applicant stated that he is looking to subdivide his property to enable his daughter to build a house.  The applicant showed the Board the land plans.

Laura Patterson, Edgehill, spoke regarding a proposed road near the property for the Avalon development.
Ken Patterson, Edgehill, spoke that he does not agree with proposal.

Vote Against without prejudice:

Continuance

#1468                           Rabinovich, Mark                                459 Massapoag Ave.
Seeking two findings and a special permit relative to proposed habitable space expansion to accommodate an increase in capacity for a licensed daycare facility in a structure on a nonconforming lot.  Property is situated in the Rural 2 Zone within the Surface Water Protection District.

Applicant had called to continue his hearing, but did not show.  The Board will continue hearing until July 14th if Applicant signs continuance on Monday or Applicant will default.

ZBA Secretary will call Applicant to inform of continuance.



#1489                           Whitman Homes                           Glendale Road
Applicant seeks a Comprehensive Permit under MGL Chapter 40B, Section 20-23 for development of thirty-two town house condominium units, comprised of nine buildings, plus one existing home located at 9 Glenview Road.  Property is located off Rob’s Lane, Town of Sharon Assessor’s Map 102- Parcels 87, 88, and 92-1 and is zoned Residential B.

Brian Wall stated he is standing in for Peter Freeman tonight.

Brian Wall briefly reviewed project and took the Board through each section in the Application and reviewed each section.

Greg Meister stated he may have comments at the next meeting.  One issue that he foresees is the potential vernal pool on the site.

Mr. Jon Witten, attorney representing Mass. Neighborhood Association, stated he should and others be entitled to a full presentation by the Applicant.  He asked for permission to walk the site with the Applicant.

Mr. Rhodes, Applicant engineer, stated they do not have a problem allowing Greg and others walk the property.

Jon Witten, brought paragraph 3 in the Mass Housing Development letter to the attention of the Board.

Joanne Douglas, resident, is concerned with waste and surface water.

Lawrence Murphy, 5 Rob’s Lane, is concerned with water and how it flows off the driveway.  Also concerned with traffic on the road and where the snow will be placed.

Mike Dickens, 111 Glendale Rd., stated he feels that the issues of previous proposal (1995 and 1999) for a 7 house development should be taken into consideration.

Blair White, 92 Glendale Rd., stated traffic is an issue as there are no sidewalks on Glendale.

Michelle Botash, Glenview, stated it is a very hilly area and dangerous.  There is no other way to get out if someone gets stuck on the hill in the winter.

Mr. Rhodes stated they had conversations with Fire Chief and Applicant is willing to widen the road.

Discussion around holding a workshop with various representatives was discussed.  Greg Meister thought it would be a good idea.

Hearing Continued until June 9.




Next Zoning Board Meeting scheduled on Wed., May 26 at 8:00 p.m. in Town Hall.
